Update: Amber Alert Cancelled After Oakland Woman Reportedly Admits Making Up Story

OAKLAND (KRON) -- An early Friday morning Amber Alert is now cancelled after police say a woman made up the story that her husband had kidnapped their one-year old child at gunpoint.

"There is no child," Oakland police spokeswoman Joanna Watson says.  "This was made up by the victim this morning.  Investigators are continuing to interview her as to why she did this and we are going to be cancelling the Amber Alert."

Police say they received a 911 call at 12:44 a.m. about a domestic violence dispute near 94th Avenue and Holly Street in East Oakland.  When officers arrived a woman says she got into a fight with her husband, 56-year old Kim Tolefree.

According to the story police say they were first told, the woman says her husband assaulted her at gunpoint, then when she tried to get away, rammed her car and drove away with the child.

Police say Tolefree later turned himself in after hearing about the Amber Alert.  He denied taking any child.

Authorities are now trying to determine what should happen to the woman who they say made up the story.

"This is very concerning to us," Watson says.  "An Amber Alert is the highest level.  When you say there's a child involved and is in dangerous situations, that's always a concern not just for law enforcement but for our community.  It's a gross misuse of the system.  It also has implications for, the information that we received being dangerous for the husband.  We are treating him as armed and dangerous because of this information.  We've activated an Amber Alert.  So those are very serious concerns and what the investigators now have to deal with."

It will eventually be up to the Alameda County District Attorney's office to decide if any charges should be brought in this case.
