California gun owners must go through second waiting period for second gun

SAN FRANCISCO (AP) – A federal appeals court says California can withhold guns for 10 days from gun buyers who previously purchased a gun and clear a background check before the 10-day waiting period.

A three-judge panel of the 9th U.S. Circuit Court of Appeals on Wednesday said the application of the state’s 10-day waiting period to such gun owners was a reasonable safety precaution and didn’t violate the 2nd Amendment.

The ruling overturned a lower court decision that found the law was unconstitutional when applied to existing gun owners and people with concealed weapons permits who passed background checks before the 10-day period.

Two gun owners and two gun-owner rights groups, The Calguns Foundation and Second Amendment Foundation, sued over the state waiting period in 2011.
