LAS VEGAS (AP) — A public defender representing a Las Vegas mother in what authorities say was the intentional bathtub drowning of her 2-year-old daughter told a judge Tuesday that she’ll challenge her client’s alleged confession to police.
Defense attorney Sarah Hawkins said it wasn’t clear the police report was accurate or that defendant Linette Fay Boedicker’s statement was lawfully obtained.
Prosecutor Mariya Malkova told the judge that defendant Boedicker “admitted to police officers that she murdered her 2-year-old child, that she drowned her 2-year-old child in a bathtub.”
Boedicker, 44, who also uses the name Warrichaiet, stood in shackles and wasn’t asked to enter a plea.
Hawkins also objected to video media coverage of her client’s court appearance on a murder charge.
Las Vegas Justice of the Peace Joe M. Bonaventure allowed news cameras to remain as he set Boedicker’s bail at $1 million and scheduled a court date Friday.
Hawkins sought $50,000 bail and house arrest or electronic monitoring for Boedicker, saying she had no felony record and has lived in Las Vegas for at least five years.
She said outside court that Boedicker would not be able to post the $1 million amount set by Bonaventure.
The attorney also asserted her client’s right to have a lawyer present during interviews by authorities.
Police said Boedicker called 911 on Saturday and told a dispatcher that she held her daughter under water until she stopped breathing and refused instructions from the dispatcher to remove the child from the water and begin CPR.
Police said officers found the child, Kiersten Linette Boedicker, still in the water.
Police said Boedicker’s husband was at work at the time.
Officers summoned to the apartment several hours earlier on a domestic disturbance call determined no crime had been committed, police said.
